Not candid or sincer...(dis·in·gen·u·ous Adjective <br />Not candid or sincere, typically by pretending that one knows less about something than one really does)<br /><br />Thank you, Legal Aid Domestic Violence Caseworker from Tennessee for your comment, however, it's obvious you have yet to read the information contained in the book, "Time's Up."<br /><br />When you do, you will see that there are very explicit procedures outlined that would have guided Ms. Barnes to safety, much more than she would ever get from Legal Aid, a shelter or coalition as a resource. Granted, her narrative in the OP may contain the evidence needed, but the Evidentiary Abuse Affidavit takes that information to new levels. Had she completed the procedure, there would be no defense attorney asking for prior evidence to be left out. The EAA would be admitted as her testimony, bypassing Crawford v Washington and hearsay laws, just like a last will and testament.<br /><br />The fact that Ms. Barnes is now dead, even after following the standard procedures, leaves blood on the hands of those who guided her. They did not do enough.<br /><br />Susan Murphy Milano has been assisting high risk victims for 20 years, and not one has died on her watch. Ms. Barnes did in fact have a Order of Protection against Mr. Lambert, but he chose to violate it when he sought her out at the motel. An Order of Protection in Tennessee sets out in narrative form, written by the victim, exactly what acts of violence have occurred, their fear of injury or death and it is on that basis that the Order is granted. Therefore, that evidence is already in existence. The fact is, when someone is dead set on killing you, an Order of Protection means nothing to them and is merely a piece of paper. I believe that this is why many abused partners stay in abusive relationships for lack of realistic tools to deal with unreasonable and violent people. Just as criminals have no respect for the law, so abusers have no respect for peaceful resolution and detachment. <br /><br />The “Time’s Up!” guide which outlines how to leave an abusive partner safely is essential for anyone going through the very dangerous process of leaving an abusive relationship.
